1. Agreement to Terms
Welcome to My Holy Grail! These Terms of Service (“Terms”) govern your access to and use of the My Holy Grail mobile application, website, and related services (collectively, the “Service”) operated by My Holy Grail, LLC (“My Holy Grail,” “MHG,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, please do not use Service.
2. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If we learn that a user under 16 has created an account, we will promptly delete that account and any associated data.
3. Your Account
To access certain features, you must create an account. When you do, you agree to provide accurate and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
If you believe your account has been compromised, contact us immediately at support@myholygrail.app. We are not liable for any loss resulting from unauthorized use of your account.
4. User-Generated Content
4.1 Your Content
The Service allows you to post reviews, ratings, rankings, comments, photos, and other content (“User Content”). You retain ownership of your User Content, but by posting it on the Service, you grant My Holy Grail a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and create derivative works from your User Content in connection with operating and improving the Service.
4.2 Content Standards
You agree that your User Content will comply with our Community Guidelines and that it will not:
Violate any applicable law or regulation
Infringe on the intellectual property or other rights of any third party
Contain false, misleading, or deceptive information
Include harassment, hate speech, threats, or abusive language
Contain spam, unsolicited advertising, or promotional material
Include malware, viruses, or other harmful code
4.3 Content Moderation
We reserve the right, but are not obligated, to review, edit, or remove any User Content at our sole discretion, including content that we believe violates these Terms or our Community Guidelines, or that is otherwise objectionable.
5. Prohibited Conduct
When using the Service, you agree not to:
Create multiple accounts, or create an account after your previous account has been suspended or banned
Impersonate any person or entity, or misrepresent your affiliation with a person or entity
Use the Service for any commercial purpose without our prior written consent
Interfere with or disrupt the Service, servers, or networks connected to the Service
Use automated means (bots, scrapers, crawlers) to access the Service or collect data
Attempt to gain unauthorized access to any part of the Service or other users’ accounts
Manipulate ratings, rankings, or reviews through fraudulent means
Use the Service in any way that violates any applicable local, state, national, or international law
6. Intellectual Property
6.1 Our Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of My Holy Grail, LLC. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
6.2 Copyright Complaints
If you believe that content on the Service infringes your copyright, please contact us at support@myholygrail.app with the following information: a description of the copyrighted work, identification of the infringing material, your contact information, and a statement that you have a good faith belief the use is not authorized. We will respond to valid notices in accordance with applicable law.
7. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by My Holy Grail. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.
8. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
My Holy Grail does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. User Content, including reviews and recommendations, reflects individual opinions and experiences. We do not endorse or guarantee the accuracy of any User Content.
My Holy Grail does not provide medical, dermatological, or professional beauty advice. Information and recommendations shared on the Service are for informational purposes only. Always consult a qualified professional before making decisions about skincare treatments or products, especially if you have allergies, sensitivities, or medical conditions.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY HOLY GRAIL, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless My Holy Grail, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also delete your account at any time through the app settings.
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.
12. Dispute Resolution
12.1 Informal Resolution
Before filing a formal dispute, you agree to try to resolve it informally by contacting us at support@myholygrail.app. We’ll try to resolve the matter within 30 days.
12.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State in which My Holy Grail, LLC is organized, without regard to its conflict of law provisions.
12.3 Class Action Waiver
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis, and you waive the right to participate in a class action, class arbitration, or other representative proceeding.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the app or via email before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and My Holy Grail, LLC regarding your use of the Service, and supersede all prior agreements.
